Real Estate Litigation is a broad and complex area of the law which includes actions involving eminent domain/condemnation [see separate section above], partition, easements, title challenges, right-of-ways and boundary lines, quiet title, rescission and fraud, breach of lease or purchase contract, commercial & residential property sales, inadequate disclosures by owners and brokers; land use and zoning applications before governmental bodies, environmental contamination (CERCLA claims), neighbor disputes over trees, dust, views and noise, timber harvest (THP) and NTMP permits, loan workouts with Deeds in Lieu of foreclosure, oversight and drafting of commercial and residential leases and purchase contracts, and many more. These cases come before local government councils, boards, and administrative agencies, as well as the State and Federal courts. Over 26 years, I have developed the required experience and skill as a trial attorney to handle these cases. I have litigated, settled or tried to jury verdict real estate litigation cases in over twenty (20) different counties in the Superior Courts of California, ranging from Shasta County to the San Francisco Bay Area, from the Tahoe State line to Stockton, and Los Angeles to San Diego. To give a few examples:
I successfully tried to verdict a 2,000 acre timber land partition case in San Mateo County Superior Court involving complex land and timber appraisals and surveys, as well as endangered species and "Old Growth" Redwood issues. I was subsequently retained by the owners to handle the property's Timber Harvest Permit (THP) applications, operations, easement disputes and other real property matters. I successfully settled for another client a partition matter in Sonoma County Superior Court involving 3,000 acres of timber and coastal lands off of Highway 1.
I successfully managed and completed the environmental cleanup project overseen by the State Dept. of Toxic Substances Control (DTSC) for my client's property in San Rafael, CA, which was adjacent to Highway 101 South, and involved complex issues of above and below ground contamination, lab testings, excavation and disposal. I am presently representing other clients in the Alameda Superior Court and United Stated District Court - Northern California, for their property in the City of Emeryville CA, involving PCE and VOC contamination issues on industrial properties.
I have represented clients on various land use applications and disputes (e.g. building permits; remodel applications; access roads & easements; air-light & tree-root issues) before the City of Larkspur City Council, the Marin County Board of Supervisors, the Emeryville City Council, South Lake Tahoe Redevelopment District, to name a few. I also have successfully settled encroachment and lot-line adjustment cases in the Mill Valley and Larkspur.
I always offer a FREE one-half (1/2) consultation to prospective clients to see if I can help you, and to let you know what your options may be. In large law firms, many times the client's real estate case is bounced around to a number of different lawyers who have less experience than the named partners, but who still charge a very high hourly fee for services due to their firm's high overhead expenses. In comparison, as a sole practitioner, I can offer a very competitive hourly fee for my clients, along with direct, personal attention to your case. I also gladly pay referral fees to attorneys consistent with Cal. State Bar, Rules of Professional Conduct 2-200.
